SC LIS SRL will process your data in an honest, transparent and informed manner, according to the changes and modifications brought by the General Regulation (EU) on the data protection of natural persons no. 2016/679 (hereinafter the Regulation). This document tells you how we collect, use, transfer and protect your personal data when you interact with us in relation to our products and services through our website.

2. What is personal data?

Personal data are any data or information that directly identifies a person (e.g. name, surname) or indirectly (IP address, online identifiers, etc. that can be associated with a person under certain conditions).

3. The personal data collected and the method of processing

SC LIS SRL collects personal data only under the conditions of art. 6 paragraph 1 letters a), b), c) and f) of the Regulation, respectively the data necessary for the execution of the contract (the delivery of the ordered products) or those necessary for the purpose of the legitimate interests pursued by the operator or a third party, except in the case overriding the interests or fundamental rights and freedoms of the data subject.

For this purpose we collect and process:

  • Name and surname;
  • Email address and delivery address
  • Phone number;
  • Information about purchased products;
  • Your usage and activities on the Site;
  • Interests and preferences related to our products.

We collect the name, surname, email address, phone number and delivery address pursuant to art. 6 paragraph 1 letter b) of the regulation, in the situation where you decide to purchase a product and for the purpose of its delivery.

In the event that the payment is made by bank card, the data about your card are not accessible to us, being collected and processed directly by the payment processor Netopia Payments, according to its own processing policies, accessible at this link (opens in a new window).

Additionally, if you want to return the product, we will ask you for the IBAN bank account, as this is necessary for us to refund the value of the returned product.

We also use Facebook’s custom audience services (Facebook Pixel). With the help of this service offered by Facebook, we can measure the effectiveness of our advertising campaigns. The data collected by Facebook through the Facebook Pixel serves exclusively to compile statistics on the success and use of our advertising campaigns on Facebook and is not sufficient to determine the identity of the person.

Also, for the same statistical purpose we use Google Analytics, the data collected through this application being anonymized including at the IP level and serving exclusively for statistical purposes (measuring the number of visitors), not being able to identify the person behind the data generated.

Pursuant to art. 6 paragraph 1 letter f) of the regulation (existence of a legitimate interest), the infrastructure on which the site operates collects the IP address and the characteristics of the browser used, these data being necessary for the purpose of ensuring the security of the site, preventing unauthorized access and fraud IT and platform security maintenance. On the same basis, we will process the personal data provided by you in the event that this is necessary for the defense of rights in court for the recovery of amounts owed, or for the protection of interests against unjustified claims/complaints.

We will also process your personal data (name, surname, delivery address) for the preparation of the annual financial statements, as well as for the submission of tax and accounting declarations to the tax authorities, the basis of the processing being in this case art. 6 paragraph 1 letter c) of the regulation, respectively for compliance with the legal obligations imposed by the legal provisions applicable in fiscal and accounting matters.

In the event that you directly express your consent when completing the order, we will process your email address also for the purpose of direct marketing, through newsletter type information.

4. Data retention period

We will process personal data only for the period necessary to execute the contract and comply with our legal obligations, respectively:

  • for the period for which we need your data to provide you with the requested products and fulfill our obligations to you;
  • in the event that you have created a customer account, we will keep the data you have provided us for as long as this account is active, but not more than 5 (five) years from the date of the last login to the account or the last order, with the sending of a notification prior to data deletion;
  • legal or contractual obligations require us to keep your data for a certain period of time (for example, the limitation periods for legal actions, or the periods established by fiscal and accounting legislation).

Upon express request, the data associated with your customer account will be deleted or anonymized so that you can no longer be identified in our data record systems, unless we are required to keep your data for a longer period, based on the law or our legitimate interest.

5. To whom we provide the collected data

For the purpose of delivering the products, we will provide the name, surname, phone number and delivery address to the fast courier with which we make the delivery and to the bank card payment processor, in the case where this payment method is used.

6. When do we transfer your data outside the European Union or EEA?

We do not transfer your personal data outside the E.U.

SC LIS SRL currently implements all technical and organizational measures necessary for the collection, processing and safe keeping of data, including against unauthorized access, unauthorized use of data, or destruction, loss or alteration of data. 8. Your Rights and Choices Regarding the Data We Collect

You have the following possibilities based on the available technologies:

  • you can manage from the customer account the direct access, rectification or deletion of some data available in your customer account;
  • you will be able to delete cookies or browsing history from the site settings or you can choose to change the settings of the browser you are using so as to restrict the tracking by cookies of your behavior on the site.
  • social media platforms and search engines (e.g. Google or Facebook) give you the possibility to manage various options regarding how you choose to process your data.

The regulation also offers you, as a data subject, the rights described below. Before complying with any request regarding your rights, we will ensure that you are the owner of the data with respect to which you choose to exercise these rights, and for this purpose we may request some information/data from you to verify your identity, or we may request more many details about your request. We may keep the correspondence we have with you to ensure that we keep track of your requests and responses regarding your rights:

  • The right to be informed. You have the right to receive clear, transparent, easily understandable and easily accessible information about how we process your data, including details of your rights as a data subject. This information about the data, the purpose and the way we process your data is also included in this Policy.
  • Right of access to data. You have the right to access the data we process about you, without charging any kind of fee for the first data supplies. If you require copies of data already provided, we may charge a reasonable fee taking into account the administrative costs of providing the data. We will have the right to refuse excessive or repeated and unreasonable requests.

You have the right to obtain from us the restriction of data processing when: the accuracy of the data is contested for a period that allows verification of the correctness of the data; data processing is illegal, but you will oppose the deletion of the data and request the restriction of the processing of this data; we no longer need your data, but it is requested by you to establish, exercise or defend legal claims; in case of raising objections regarding the processing of data based on the legitimate interest, following the verification of the proportionality between the legitimate interest of the operator and the rights of the data subject.
  • The right to portability. You have the right to transfer your data: to you or to another operator indicated by you.
